These Terms of Service govern your use of Sleek - To-Do & Task Manager ("Sleek"), our website located at https://kapps.us, and any related services provided by Kapps LLC ("Kapps", "we", "us", or "our").
By using Sleek, you agree to abide by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with these Terms of Service, you are prohibited from further using the app, accessing our website, or using any other services provided by Kapps.
If you access or download Sleek from the Apple App Store, you agree to any Usage Rules set forth in the App Store Terms of Service.
Amendments
We reserve the right to amend these Terms of Service at our discretion. We will notify users of changes by updating the date at the top of this page and, where appropriate, through notification within the app or via email. Your continued use of Sleek after changes are published constitutes acceptance of the updated terms.
Limitations of Use
By using Sleek, you warrant on behalf of yourself and any entity you represent that you will not:
- Modify, copy, prepare derivative works of, decompile, or reverse engineer Sleek or any materials contained within it.
- Remove any copyright or other proprietary notations from any materials.
- Transfer Sleek or any of its associated materials to another person or mirror the materials on any other server.
- Knowingly or negligently use Sleek in a way that abuses or disrupts our networks or any other service Kapps provides.
- Use Sleek to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material.
- Use Sleek in violation of any applicable law or regulation.
- Use Sleek to send unauthorized advertising or spam.
- Harvest, collect, or gather user data without the user's consent.
- Use Sleek in a way that may infringe the privacy, intellectual property rights, or other rights of third parties.
Intellectual Property
The intellectual property in the materials in Sleek and on our website are owned by or licensed to Kapps. You are granted a limited license only for the purpose of viewing and using Sleek for your personal, non-commercial use. This license terminates upon violation of these Terms of Service or at Kapps's discretion.
User-Generated Content
You retain your intellectual property ownership rights over content you submit to us (such as task titles, notes, and list names). By providing content to Sleek, you grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, distribute, modify, run, copy, publicly display, translate, or otherwise create derivative works of your content in a manner that is consistent with your privacy preferences and our Privacy Policy.
This license terminates when you delete your content or your account, except where your content has been shared with others and they have not deleted it.
Automatic Updates
You give us permission to download and install updates to Sleek on your device in accordance with your privacy preferences. You may revoke this permission at any time by deleting Sleek from your device.
Subscriptions and In-App Purchases
Auto-Renewable Subscriptions
Sleek offers the following auto-renewable subscription plans ("Sleek Pro"):
- Monthly: $1.99 per month
- Yearly: $17.99 per year
Sleek Pro unlocks unlimited lists and tasks, private lists, custom themes and fonts, and an ad-free experience.
Subscription Terms
- Payment is charged to your Apple ID account at confirmation of purchase.
- Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period.
- Your account is charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
- You can manage and cancel your subscriptions by going to your device Settings > Apple ID > Subscriptions.
- Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
Pricing
Subscription prices may vary by region and are subject to change. Price changes will be communicated in advance and take effect at the start of the next billing period.
Legacy Purchases
Users who previously purchased a one-time lifetime unlock retain their Pro access. This one-time purchase option is no longer available for new users.
General In-App Purchase Terms
All billing for in-app purchases and subscriptions is processed by Apple Inc. ("Apple") and is governed by Apple's own terms and conditions. In-app purchases cannot be cancelled after download has been initiated and cannot be redeemed for cash or transferred to other accounts.
If you experience issues with a purchase, contact Apple Support for refund requests. Apple's refund policy applies.
Liability Disclaimer
Sleek and the materials in Sleek and on our website are provided on an "as is" basis. Kapps makes no warranties, expressed or implied, and hereby disclaims all warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property.
In no event shall Kapps or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use Sleek or the materials in Sleek, even if Kapps has been notified of the possibility of such loss. "Consequential loss" includes but is not limited to loss of profit, loss of revenue, loss of data, or data corruption.
Accuracy of Materials
The materials appearing in Sleek or on our website are not comprehensive and are for general information purposes only. Kapps does not warrant or make any representations concerning the accuracy, likely results, or reliability of the materials.
Third-Party Links
Kapps has not reviewed all of the sites linked to Sleek or on its corresponding website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement, approval, or control by Kapps. Use of any linked site is at your own risk.
Apple-Specific Terms
For users who download Sleek from the Apple App Store:
- These Terms of Service are between you and Kapps only, not with Apple Inc. ("Apple").
- Apple provides no maintenance or support obligations for Sleek.
- In the event of Sleek's failure to conform to any applicable warranty, Apple's sole responsibility is to refund the purchase price (if any).
- Apple is not responsible for addressing any claims by you or any third party relating to Sleek, including product liability claims, regulatory compliance claims, consumer protection claims, or intellectual property infringement claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms of Service and may enforce them.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government restricted party list.
Termination
We may suspend or terminate your Sleek account and right to use Sleek immediately upon written notice to you for any breach of these Terms of Service.
Severance
If any provision of these Terms of Service is found to be invalid or unenforceable under applicable law, such provision shall be severed and the remaining provisions shall continue in full force and effect.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of New York. You irrevocably submit to the exclusive jurisdiction of the courts in New York.
